Course Synopsis

The morning foundational module of the Course is intended to introduce experts and lawyers to the legal framework for Expert Evidence both in Singapore and internationally.  Amongst other things, the Course will cover:

  • The disputes framework – the court system in Singapore and the international arbitration framework based on the UNCITRAL Model Law regime
  • The role of the expert under the law
  • Civil Law v Common Law approaches to evidence including Expert Evidence
  • The expert’s duties and obligations within the disputes framework
    • Singapore courts
    • Singapore International Commercial Court (SICC)
    • International arbitrations
  • The treatment of expert evidence in disputes both in Singapore and internationally
    • SICC Rules
    • International Bar Association (IBA) Rules on the Taking of Evidence in International Arbitration
    • Rules for Expertise of the International Chamber of Commerce
    • The Meeting of Experts - procedures and problems
    • APIEx Code of Conduct for Experts

The Course will include both lectures on materials to be provided as well as discussions led by the instructors based on actual legal cases as well as their personal experiences in dealing with expert evidence both in Singapore and internationally.

Although meant as an introduction to the legal aspects of the appointment of experts for disputes work and the expert’s duties and obligations, practicing experts and lawyers may also find the Course useful as a refresher on the intricacies of expert evidence.  

In the afternoon, we will feature an optional Specialist Track specifically designed for architects and led by Architect Darren Benger who will share his experiences acting as an expert witness in various architecturally-related disputes, in litigation, arbitration and strata title board matters.

Darren will address various expert-witness topics from the perspective of an Architect within a construction-industry context, seeking to address questions that Architects intending to act as expert witnesses would be asking.  This section will be conducted using adult learning strategies including technology for live interaction and breakout group discussions.

All those who practise as experts, lawyers, those who instruct lawyers and experts as well as those aspiring to practise as experts.

Flexible Attendance Options

For this intake of the Course, participants will have the option to:

  1. Attend the full-day Course (Foundational Module and Architect Specialist Track) in-person; OR
  2. Attend the full-day Course in hybrid format, i.e. Foundational Module virtually and Architect Specialist Track in person; OR
  3. Attend the Architect Specialist Track in-person; OR
  4. Attend the Foundational Module, Revision Session and Examination; OR
  5. Attend the Foundational Module only (no Certificate of Completion issued).

Completion of the Course

To complete the Course successfully and be awarded with a Certificate of Completion, a candidate must:

(a)  Achieve 100% attendance at Foundational Module and Revision Session; and
(b)  Pass the 90-minute written assessment (passing mark 80%).

Successful completion of the Course would entitle applicants for membership in APIEx to the following exemptions:

  • Individual Member applications: Waiver of the requirement for a specimen report.
  • Fellow applications: Waiver of one specimen report (out of the three required). 

APIEx is pleased to announce that the Intellectual Property Office of Singapore (IPOS) now recognises that:

  1. experts with a minimum 10 years of experience in IA/IP valuation (with no prior experience acting as an expert witness or assessor); and
  2. who successfully complete APIEx’s International Membership Accreditation Course 2025, will meet the criteria for being listed on IPOS’ List of IA/IP Valuation Experts).

APIEx’s International Membership Accreditation Course is also one of the recognised requirements for acceptance to the IPOS List of Technical Experts. The full criteria can be found HERE.

About the Course Faculty

 

Prof. Leslie Chew SC - President, Asia Pacific Institute of Experts; Dean, School of Law, Singapore University of Social Sciences; Consultant, Peter Low Chambers LLC

Prof. Leslie Chew SC is the founding and current Dean of the School of Law at the Singapore University of Social Sciences.  He has practiced law in one form or another for over 4 decades.  He was appointed Senior Counsel in 2000.  In 2007 he was appointed a judge in the State Courts where he remained until his retirement in 2014.  At the State Courts he was the Senior District Judge leading the Civil Justice Division.  He retired from the judiciary in 2014. Upon his retirement from the Singapore Legal Service, he returned to law practice. Currently, he is a Consultant at Peter Low Chambers LLC.  He has an active practice as an arbitrator in International Commercial Arbitrations
 

Dr. You Chuanman - Senior Lecturer, School of Law, Singapore University of Social Sciences

Dr Chuanman You is currently a Senior Lecturer at the School of Law, Singapore University of Social Sciences, where he specialises in the areas of corporate and financial regulation, law and artificial intelligence, data and platform governance, geopolitics and global sanctions. He was appointed as a Council Member of the Law Society of Shenzhen, China (2024-2029).
Prior to joining SUSS Law, Dr You has worked at the Chinese University of Hong Kong (Shenzhen), National University of Singapore, Singapore Management University, and Tel Aviv University. Dr You obtained his PhD from England focusing on comparative takeover regulation and path dependency theory. He additionally holds a Master Degree in Law and Economics (EMLE) from Germany, an MPhil in Law and History and an LLB in Civil and Commercial Law from China. Dr You has published extensively in leading academic outlets, including the Journal of Business Law, Computer Law & Security Review, and the Capital Markets Law Journal. Frequently featured in international media such as Bloomberg, the Wall Street Journal, and the South China Morning Post, Dr You is recognised for his expertise in China’s evolving regulatory environment. He regularly presents at global conferences on issues ranging from financial technology and platform governance to cross-border mergers and acquisitions.
 

Ar. Darren Benger - Committee Member, Asia Pacific Institute of Experts; Managing Director, VivATA Singapore

Darren received his Bachelor of Architecture degree with First Class Honours from the University of Adelaide, Australia in 1995, and registered with the Board of Architects, Singapore in 2001. In respect of architectural practice, Darren is also a Registered Inspector for fire safety, a Design-for Safety Professional/trainer and a Universal Design Assessor.
Since 1996 Darren has resided in Singapore, and he is currently Managing Director of the architectural practice VivATA Pte Ltd and served as an elected member of the Board Of Architects, Singapore, for the 2023/24 term. Darren is also involved in the Singapore Institute of Architects, including election to Council from 2007 to 2021. He has actively participated in various SIA committees, including the Building Contracts Committee as well as the Architectural Practice Committee and ADR Committee (which he also chaired at various stages). Darren is listed on SIA's panels of Arbitrators and Expert Determinators. In respect of construction law and alternative dispute resolution, Darren served on the Council of the Society of Construction Law (Singapore), including as chairman for the 2014-15 term. Darren is also a Fellow of the Singapore Institute of Arbitrators, and attained the Graduate Certificate in International Arbitration from NUS in 2011.
Darren has acted as an Expert Witness in various arbitration, litigation and strata-title-board matters. He is pleased and honoured to be elected to the APIEx Committee for the 2025/26 term

Registration, Refund & Cancellation Policy

By completing the online registration form, Event registrants confirm their acceptance of the following Terms and Conditions:

  1. Places at the Event are limited and will be allocated by the Organiser at its discretion based on various criteria and in order of priority upon receipt of registration and all payments due.
  2. The Organiser reserves the right to update or amend the details of the programme and/or the speakers without prior notice.
  3. The Organiser reserves the right to refuse to register or admit any participant, and to cancel or postpone the Event.
  4. No refunds will be made for cancellations or no-shows by registrants. However, a confirmed registrant who has paid the registration fees but does not turn up for the Event will be entitled to a set of the materials provided, if any.
  5. If any registrant is unable to attend the Event, an equivalent substitute may attend instead at no extra charge, provided that at least 3 days prior written notice is given to the Organiser. All such requests will be considered at the Organiser’s discretion and subject to any applicable top-up in fees.
  6. Holding of any in-person Event may be subject to the approval of any relevant government authorities for public health or other reasons.
  7. In-person attendees at the Event must abide by any relevant public health or other measures imposed by the Government, the Event venue and the Organiser.
  8. The Organiser encourages any registrant displaying any COVID-19 symptoms to perform self-testing. Any registrant who tests positive is encouraged not to attend the Event and inform to the Organiser accordingly.
  9. As of 10 October 2022, the Vaccinated Differentiation Safe Management Measures (VDS) have been fully lifted in Singapore and the Organiser will no longer be requesting the verification of COVID-19 vaccination status for entry to the Event. However, in the lead-up to the Event, the Organiser will monitor the situation closely and be in touch again should there be further changes to the prevailing national guidelines.
  10. Mask wearing is optional at all times during the Event. Please practice good personal hygiene, including frequent washing of hands and use of hand sanitisers.
